Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Nocito Private Reminder™ ("the app", "the service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

These Terms apply to the Android app Nocito Private Reminder (package com.nocito.reminder) and to any updates to it. They are separate from the terms of Nocito™ Expense Tracker, which is a different app.

2. What Nocito Private Reminder™ Is — and Is Not

Nocito Private Reminder™ is

• A personal app for capturing reminders, tasks, notes and events by voice, text or manual entry
• An AI-assisted tool that turns what you say into organised items, using speech recognition and AI that run on your own phone
• A local-first app — your items are stored on your device and no Nocito account is required

Nocito Private Reminder™ is not

• An emergency, medical or safety alert system
• A calendar integration or calendar sync service
• A cloud sync or cloud backup service
• A system for legally or professionally binding deadlines
• A general-purpose chatbot or internet search

3. AI Accuracy and Limitations

Nocito Private Reminder™ uses speech recognition and AI models that run on your device. This process can produce errors, including but not limited to:

• Misheard words, names, numbers, dates or times
• Wrong item type, list, priority, repeat rule or alert settings
• Missed, merged or wrongly split items when several things are said in one recording
• Results that are slower or less accurate on phones with limited memory or processing power, or when the device is busy or hot

Local models can be less accurate than large cloud models. Processing time depends on your phone, the selected model and available resources. Some processing modes need the app in the foreground.

You are responsible for reviewing what the app understood before relying on it. A reminder with a valid date and time may fire before you accept it in Review. If essential scheduling information is missing, the app does not schedule that incomplete reminder until you complete it. We do not guarantee the accuracy of AI results and accept no liability for decisions made based on them.

4. Alarms and Notifications

Reminders are delivered by Android alarms and notifications. Delivery depends on your device and settings and cannot be guaranteed. Reminders can be late, silent or missed if, for example:

• Required notification or exact-alarm permissions are denied or later removed
• Battery optimisation, power-saving or manufacturer restrictions limit the app
• The app has been force-stopped, or the phone is switched off or in a restricted mode
• Do Not Disturb, focus modes or system updates change how alerts are shown

The app checks the permissions it needs, restores scheduled alerts after a restart, app update or time change where Android allows it, and offers a test reminder in Settings. These measures reduce, but do not remove, the risk of a missed reminder.

5. Optional Local Desktop Connection

You can optionally enable a connection that lets a paired browser on your local network view and edit your items. It is off until you turn it on.

• The connection currently uses local HTTP, not encrypted HTTPS. Pairing restricts access but does not encrypt network traffic
• Use it only on networks and computers you trust, never on public Wi-Fi, and turn it off when you are finished
• Changes made in the browser apply to the data on your phone
• You are responsible for the security of the network and computer you connect

6. Your Responsibilities

By using Nocito Private Reminder™, you agree to:

• Use the app for lawful purposes only
• Not record or store other people’s speech or information without any consent that the law requires
• Check the results of AI processing before relying on them for anything important
• Keep your own backups of anything you cannot afford to lose
• Not attempt to reverse-engineer, modify, or redistribute the app
• Not use the app in any way that could harm other users, third parties, or the integrity of the service

7. Free Use, Trial and One-Time Purchase

What is free

Manual reminders, tasks and notes, and access to your existing items and reminders, are free. No payment information is required to use them.

Trial of voice and AI

Voice and AI capture can be tried for up to 30 recordings or 30 days from your first AI use, whichever comes first. A recording can produce several items. Retrying the same recording does not use a new recording. AI organisation of typed text and adding to an existing recording are part of AI access.

One-time unlock

After the trial, continued voice and AI use is unlocked with a one-time in-app purchase through Google Play. The regular price is EUR 3.99; Google Play shows the price for your region at the time of purchase. By purchasing:

• You agree to the price displayed at the time of purchase
• There is no subscription and no automatic charge, and the trial does not charge you automatically
• You can restore the purchase on the same Google Play account
• If you do not buy, your existing items and reminders remain available
• Refunds are subject to Google Play’s refund policy
• We may change the price or offer promotions for future purchases; a promotion applies only when it is shown to you at the time of purchase

8. AI Model Downloads and Device Requirements

The app downloads its speech and AI models separately over HTTPS (for the recommended setup, approximately 4.75 GB on a fresh installation). This requires an internet connection and enough free storage. You can postpone setup and use manual entry in the meantime.

Larger models need more free memory and are not suitable for every phone. We do not guarantee that every model will run on every device, or that processing will finish within a particular time.

9. Data and Privacy

Your use of Nocito Private Reminder™ is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

The key commitments:

• Your items, recordings and settings are stored on your device; no Nocito account is required
• Speech recognition and AI organisation run on your phone; your recordings, transcripts, reminders and notes are not uploaded to a cloud AI service
• There is no developer-hosted copy of your data, no automatic cloud sync and no automatic cloud backup
• Model files are downloaded from a third-party host and purchases are handled by Google Play, as described in the Privacy Policy
• Exports, backups and the optional local desktop connection can transfer data to destinations you choose; that is your decision and responsibility
• Uninstalling the app or clearing its storage deletes the local data; keep your own backups

10. Intellectual Property

All content, design, code, and branding in Nocito Private Reminder™ — including the Nocito™ name, logo, and app icon — are the property of Nocito™ and are protected by applicable intellectual property laws.

Your items and recordings belong to you. We claim no ownership over the data you enter or capture in the app.

You may not use the Nocito™ name, logo, or any of our branding without prior written permission.

11. Disclaimer of Warranties

Nocito Private Reminder™ is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, error-free, or secure
• Warranties that alarms and notifications will be delivered on time
• Warranties regarding the accuracy of speech recognition or AI results
• Warranties that the app will meet your specific requirements or run on your device

12. Limitation of Liability

To the maximum extent permitted by applicable law, Nocito™ and its developers shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Missed, late or incorrect reminders, or errors in AI results
• Decisions made, or actions not taken, based on the app
• Loss or exposure of data through exports, backups, shared files, lost devices or the optional local desktop connection

In any case, our total liability to you shall not exceed the amount you paid us for the app in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Termination

You may stop using Nocito Private Reminder™ at any time by uninstalling the app. This will delete all locally stored data.

We reserve the right to suspend or end access to the app or paid features if you violate these Terms. A one-time purchase is tied to your Google Play account and can be restored there.

14. Changes to These Terms

We may update these Terms as the app evolves. When we make material changes, we will update the date above and, where practical, tell you in the app or its release notes. Continued use of Nocito Private Reminder™ after changes take effect constitutes your acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Croatia, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Croatia.

If you are a consumer in the European Union, you may also have rights under the laws of your country of residence that cannot be excluded by this clause.
